By using this store (the "Store") or placing an order, you agree to these Terms of Service and our Privacy Policy. The Store is operated by SaxAndViolin Entertainment Inc. ("we," "us"), 142–757 West Hastings Street, Vancouver, BC V6C 1A1, Canada. If you don't agree, please don't use the Store. We may update these Terms at any time; continued use means you accept the changes.

1. Eligibility and Accounts

You must be the age of majority in your jurisdiction (19 in BC) or have a parent or guardian's consent to purchase. You're responsible for keeping your account details secure and for all activity under your account.

2. Products, Pricing, and Orders

We aim for accuracy but don't guarantee that descriptions, images, or prices are error-free. All prices are in the currency shown at checkout and may change. Submitting an order is an offer to buy; we may refuse or cancel any order (including for pricing errors, suspected fraud, or unavailability) and will refund any amount already charged. You're responsible for applicable taxes, duties, and customs charges. Payment is handled by Shopify and its payment providers.

3. Digital Products (Sheet Music, Backing Tracks, Downloads)

When you buy a digital product, you receive a limited, non-exclusive, non-transferable license to use it for your own personal, non-commercial use — including printing sheet music for your own study, practice, or performance, and using backing tracks for personal practice, rehearsal, worship, or non-commercial performance.

You may not resell, share, distribute, upload, or post the files anywhere; remove watermarks or credits; or use them commercially (paid performances, resale, sync with video, broadcast) without a separate license. Some products may carry additional terms shown on their product page, which control if they conflict with this section.

Our arrangements, engravings, and recordings are copyrighted even where the underlying hymn is public domain. Your license covers our files only and does not replace any performance, mechanical, or reproduction license you may separately need. Digital products are delivered by download after payment; please save your files promptly, as we're not responsible for lost files or device incompatibility.

4. Physical Products and Shipping

Shipping times and costs shown at checkout are estimates. Risk of loss passes to you when we hand the order to the carrier, so please provide an accurate address. International orders may be subject to duties and taxes, which are your responsibility.

5. Returns and Refunds

Digital products are final sale and non-refundable once delivered, except where required by law or if a file is defective or not as described — contact us and we'll re-deliver or refund at our discretion. Physical products may be returned per the policy shown at checkout, in original condition within the stated window. Contact us before an item ships to cancel. Your statutory consumer rights are unaffected.

6. Intellectual Property

All content on the Store — including the Rosemary Siemens and SaxAndViolin names and logos, sheet music, arrangements, recordings, backing tracks, images, and video — is owned by us or our licensors. Aside from the limited license above, you may not use or reproduce it.

7. Acceptable Use

Don't use the Store to break the law, infringe others' rights, transmit harmful code, or gain unauthorized access. We may suspend access for any suspected violation.

8. Disclaimers and Liability

The Store and products are provided "as is," without warranties except those that can't be excluded by law. To the fullest extent permitted by law, we're not liable for indirect or consequential damages, and our total liability for any claim won't exceed what you paid for the relevant product in the prior 12 months. Nothing here limits rights that can't be limited by law, including certain consumer rights.

9. Governing Law

These Terms are governed by the laws of British Columbia and applicable Canadian federal law. Subject to your local consumer-protection rights, disputes are subject to the courts of Vancouver, BC.
